ECHR starts to consider first case over asset confiscation in Crimea
The European Court of Human Rights (ECHR) has started to consider the complaint filed by PJSC “Feodosia shipbuilding company “More” (Sea) about violation of the company’s rights as a result of the illegal nationalization of its assets in Crimea.
According to the law firm “Ilyashev and Partners”, which prepared the complaint, it was accepted for consideration on May 27.
As noted in the firm, the ECHR will for the first time consider the legality of interference with the right to ownership of the assets of PJSC by the self-proclaimed authorities of Crimea without compensation of their value, as well as the violation of the right to a fair trial.
As a reminder, after Russia had annexed the peninsula, the so-called State Council of Crimea in 2014 transferred all movable and immovable property of PJSC “Feodosia shipbuilding company “More”, located on the territory of the peninsula, in its property.
Later, the head of the Russian government ordered to transfer PJSC “Feodosia shipbuilding company “More” to the Russian federal property.
The PJSC specialized in military and civil shipbuilding, in particular, designing military and civilian boats, hydrofoil boats made of light alloys, air-cushion vessels.
Warships and multipurpose boats were a significant part of production. 100% of shares of PJSC “Feodosia shipbuilding company “More” belong to Ukraine.
In 2004, the Cabinet of Ministers of Ukraine included PJSC “Feodosia shipbuilding company “More” in the list of enterprises of strategic importance for the economy and defense of Ukraine. In 2012, PJSC “Feodosia shipbuilding company “More” was included in the list of enterprises, whose corporate rights owned by the state, were transferred to Ukroboronprom state concern.
