President Poroshenko submits to Parliament draft law on High Council of Public Justice
Ukrainian President Petro Poroshenko has submitted to the Verkhovna Rada of Ukraine a draft law on the High Council of Public Justice.
As noted on the Parliament’s website, the bill No. 5180 was registered on September 23 and sent for consideration to the relevant committee on September 26.
The draft law on the High Council of Public Justice stipulates that this body of the judicial self-government will be the supreme authority in the issues of judicial career, instead of the High Council of Justice.
The document’s provisions define the rights of the High Council of Public Justice in making decisions on appointment, dismissal and transfer of judges, as well as their arrest, detention, suspension, etc.
The High Council of Public Justice will have 21 members. Ten of them will be elected at the congress of judges, two will be appointed by the president, two more – by the Verkhovna Rada. In addition, two members will be elected by the congress of lawyers of Ukraine, two more – by the all-Ukrainian congress of prosecutors, another two – by the congress of representatives of law universities and scientific institutions.
The Chairman of the Supreme Court of Ukraine will also be a member of the new body.
As reported, June 2, 2016, the Verkhovna Rada of Ukraine passed the constitutional amendments related to judiciary. September 6, 2016, the Judicial Reform Council approved the draft law on the High Council of Public Justice concerning the constitutional amendments related to judiciary (those which will enter into force on September 30).
