Poroshenko signs law allowing to register children in Crimea
President of Ukraine Petro Poroshenko has signed the law No. 3771, which amends the Civil Code of Ukraine.
These amendments will help to record the facts of birth and death on the territories, not controlled by the Government of Ukraine.
In particular, the relatives or legal representatives of a person can resort to any Ukrainian court with the petition to recognize the fact of birth or death. Previously, for example, the residents of Crimea had to resort to the Kyiv Court of Appeal with the request to determine the court which would consider the petition.
Now, an applicant may appeal to any convenient court without providing an IDP status certificate.
The law also stipulates that a court shall consider such petitions without delay and give an applicant a copy of the ruling immediately after its adoption. The court ruling must be enforced immediately.
“Of course, now it is important to set cooperation with the civil registry offices and to form the practice under which the judges will be able to deliver judgments promptly and help people to get the documents. We plan to cooperate with the Justice Ministry of Ukraine on the elaboration and spread of the guidelines and samples of petition to court to show that this procedure is easy. Our lawyers are ready to suggest how to implement it. In the future, we will work to simplify the system and transfer it from the judicial to the administrative procedure…” said coordinator of Vostok-SOS Oleksandra Dvoretska.
As a reminder, the MPs passed the law on February 4.
