Transgender and HIV-positive people will be allowed to adopt in Ukraine?
The Ministry of Healthcare of Ukraine has prepared a draft order where transgender diagnosis, as well as a number of diagnoses associated with the HIV status and disability will be removed from the list of diseases, which prohibits adoption.

The organization reminds that the order of the Ministry of Healthcare №479, as of 2008, established a list of diseases the presence of which prohibited adoption, it included a F64 group of diagnoses “gender identity disorders” on the International Classification of Diseases. Thus, transgender people, who were officially diagnosed required for recognition of their gender, have lost their right to adopt a child.
However, on February 13, the Ministry of Healthcare published a draft order for public discussion, which makes amends to the above-mentioned list. A group of transgender diagnoses, as well as a number of diagnoses with HIV status and disability will be removed from the list. The explanatory note to the draft states that the list, which is still in effect, is discriminatory and inconsistent with both international and legislation of Ukraine.
Thus, the regulatory framework of the Ministry of Healthcare is being aligned with its Unified Clinical Protocol on gender dysphoria, which expressly states: “Patients with gender dysphoria should not be denied the possibility of reproduction. And if reproduction is no longer possible due to the medical intervention – then in a right to adopt a child”.
