HQCJ to consider complaint against inconvenient Cherkasy judge
Tuesday, April 14, the High Qualification Commission of Judges of Ukraine (HQCJ) will consider the complaint of the LLC “Kaniv Left-bank Hunting Entity” against judge of the Court of Appeal of Cherkasy region Serhiy Bondarenko.

As reported, judge Serhiy Bondarenko accuses the leadership of the Court of Appeal of longstanding and systematic interference in his work as a judge.
December 5, 2013, the panel of judges, involving Serhiy Bondarenko, considered the case of the LLC “Kaniv Left-bank Hunting Entity”, which filed a legal claim to the Security Service of Ukraine, the Main Investigation Department of the Interior Ministry of Ukraine, and the prosecutor’s office on the release of property from the attachment. The law enforcers attached the company’s property since 22% of the share capital was owned by a person involved in the embezzlement in the Rodovid Bank.
Judge Serhiy Bondarenko argues that Head of the Court Volodymyr Babenko gave instructions to two other judges to deliver the judgment in favor of the LLC “Kaniv Left-bank Hunting Entity” after the first court hearing.
“When the case was again considered in the Court of Appeal on February 6, 2014, the majority voted against me. I still had the right to a dissenting opinion and I used it, as, in my view, the Court of Appeal delivered clearly unlawful judgment in those circumstances,” Serhiy Bondarenko says.
The High Specialized Court of Ukraine, having ruled in favor of the state, was guided by the legal stance of judge Serhiy Bondarenko.
The enterprise filed the complaint to the High Qualification Commission for exceeding the terms of hearing of the case for 15 days. Serhiy Bondarenko at the court hearing in Oleksandrivsky district court said that the case had been sent to the first instance to complete documentation.
