Feygin: Sushchenko is deprived of the right to defense in Russia

An illegally arrested in Russia “Ukrinform” correspondent Roman Sushchenko is deprived of the right to defense, reports Sushchenko’s advocate Mark Feygin for the “112 Ukraine” TV channel, conveys “Ukrinform”.

“I personally brought my application about my entry to the case to the investigative department and a warrant to the quarantine – there had to be no obstacles. Because I have to immediately start protection of the rights of the defendant. In particular, he was ordered a preventive measure of arrest, and I have to challenge it as soon as possible. Thus, it means that he is deprived of the right to defense”, – said Feygin.

He explained that an investigator did not pass an admission to the quarantine in accordance with the Criminal Procedural law.

“This case contains a state secret, therefore the Criminal Procedural law requires this admission to be passed to the quarantine. An investigative department and a quarantine are located in one building. “Lefortovo” (a quarantine) and an FSB investigative department are one building. And, usually, they do this in a few hours. Basically, the Criminal Procedural law gives him a right to inform an answer in 3 days”, – explained the lawyer.

However, he adds, there are no legal obstacles for providing Sushchenko with a right to defense.

“Therefore, someone did not ordered, a decision has not been taken, to allow or not to allow… There are, maybe, some problems with him. If he refused my services immediately, they would let me in. In this case, it seems there no arrangements. They understand that if I will come in, we will know much more details they do not want us to know”, – told Feygin.

As reported before, Roman Sushchenko, a correspondent of the Ukrainian news agency “Ukrinform” was arrested in Moscow on September 30 with the violation of international norms. He is accused of being an officer of the Defence Intelligence of the Ministry of Defence of Ukraine. The latter said that this is not true.

The Court of Moscow arrested him till November 30. His lawyer, Mark Feygin, could not see his client. Moreover, the consul can not see Sushchenko too.

International organizations, Ministry of foreign affairs of several countries, international and European federations of journalists called on Moscow to release him.

Roman Sushchenko works in the “Ukrinform” since 2002 and as a personal correspondent in France since 2010.
