Poroshenko wants to restore military courts because general can not be imprisoned for 7 years

President of Ukraine Petro Poroshenko proposes to restore special military courts in Ukraine.

As reported by the BBC, he wrote about this on Facebook page.

Such courts will operate in accordance with existing international practices, as the President said.

“Military specialists, military experts, and military judges, rather than civilians, should assess the actions of commanders in combat situations. At least for now, as long as this terrible, insidious hybrid war is ongoing”, – said the President.

According to him, the decision of military courts will not be questioned by the military.

The President stated that he can not remain silent after the verdict of one of the civil courts that sentenced the military general to imprisonment for 7 years. The President has not mentioned the name of the general and the name of court.

But, as is known, recently the Pavlohradsky District Court of Dnipropetrovsk region sentenced General Viktor Nazarov to imprisonment for 7 years. He is a key figure in the high-profile case of a crashed plane, which was shot down by separatists, and the deaths of 49 Ukrainian soldiers near Lugansk in June 2014.

“I understand the grief of the families. But the enemy who has treacherously invaded our land is truly responsible for the death of our heroes”, – said Petro Poroshenko.

According to him, it would be foolish to restrain commanders with judicial decisions in the context of ensuring defense capability and security.

”The commanders of all levels of military administration are faced with an issue: Should we protect the country, the judicial system of which is now created in such a way that all your decisions and actions will be treated as a crime?”, – asked Viktor Muzhenko, Commander-in-Chief of the Armed Forces of Ukraine, on his Facebook page.

He has not mentioned the general’s name or the judicial decision in question, but said that Ukraine has created “a dangerous precedent that can lead to fatal consequences in the State”.

At the same time, lawyers of the Ukrainian Helsinki Human Rights Union, while referring to the materials of the pre-trail and trial investigation, have concluded that none of the responsible persons has qualified for the performance of their duties professionally and thoroughly during the military operation for the redeployment of additional capabilities.

According to human rights defender, not only the military commanders have not approached the planning of the operation with thoroughness, but also cynically ignored all warnings and sent 49 soldiers to the veritable death.

In addition, lawyers have noted the responsibility of the lower-ranking people, who also had operational information, and had to take necessary security measures, but blindly followed the orders, thus not preventing the disaster.

In December 2015, Lawyers of relatives of the deceased have filed a complaint to the European Court of Human Rights regarding the ineffectiveness of the investigation. The complaint is currently is under consideration, which indicates that the ECHR has accepted the arguments of Ukrainian lawyers.

As a reminder, the Ukrainian military transport aircraft crashed on June 14, 2014. The aircraft flew from Dnipropetrovsk, and was fired on during a landing at the airport in Lugansk. Nine crew members and 40 military personnel were on board of the aircraft. All of them died.

The former head of “Lugansk People’s Republic” Valery Bolotov stated that the Ukrainian plane was shot down by representatives of the self-proclaimed republic.

Major-General of the General Staff Viktor Nazarov was arrested in November 2014. He was suspected of official negligence. The prosecution party proved that General Nazarov ignored the warning from the Security Service of Ukraine about the threat and authorized an operation to transfer paratroopers from Dnepropetrovsk to Lugansk.

Viktor Nazarov himself denies his involvement in the Il-76 crash and claims that the headquarters of the ATO received the warning from the Security Service of Ukraine too late.
