Ukrainian Ombudsperson requires adopting changes in legislation to prevent violations of freedom of association

Ukrainian Parliament Commissioner for Human Rights Valeria Lutkovska insists on preventing the violation of constitutional rights of citizens to unite in non-governmental organizations, political parties and trade unions.

As the Ombudsperson’s press service reports, she appealed to Ukrainian Prime Minister Volodymyr Groysman with a submission explaining the possible risks of human rights violations through implementation of certain provisions of the decree No. 99 on reforming the territorial bodies of the Justice Ministry and development of the free legal aid system.

The first point of this decree eliminates the legal entities of public law of the Justice Ministry’s territorial bodies, i.e. district, city district, city departments of the Justice Ministry. However, in accordance with Paragraph 14 of Part 1 of Article 1 of the Law on state registration of legal entities, individual entrepreneurs and non-governmental formations, solely the district, city district, city (cities of regional importance), inter-district department of the Justice Ministry shall have the authority of state registration of associations.

I ask you to consider the possibility of urgent preparation of the amendments to the Law of Ukraine ‘On State Registration of Legal Entities, Individual Entrepreneurs and Non-governmental Formations’ to provide an effective mechanism for enforcement of the rights of Ukrainian citizens to unite in non-governmental organizations, political parties and trade unions. I ask you to take measures to prevent violations of these rights of citizens before the appropriate changes come into force,” reads the submission to the Prime Minister.

As a reminder, the right to freedom of association in political parties, non-governmental organizations, and participation in trade unions is guaranteed by Article 36 of the Constitution of Ukraine and Article 11 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
